What is California Ancillary Probate? How Do I Find a Good San Diego Probate Lawyer?

Ancillary probate is where the decedent passes away while domiciled in a state other than California, but has California property subject to probate. The reverse could be true- the decedent may probate first in California yet have an ancillary probate in another state. Ancillary probate also plays a role when foreign nationals die in California.

If you would like to start an ancillary probate in California, be forewarned. Except as otherwise provided by the California Probate Code, the administration is subject to all the CPC’s provisions concerning the administration of the decedent’s estate, such as opening estate administration, inventory and appraisal, creditor claims, estate management, independent administration, compensation, accounts, payment of debts, distribution, and closing estate administration.
